By accessing or using YellowMint Technology’s services, including our web hosting, HRMS (Human Resource Management System), and web analytics platforms (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Services.

2. Description of Services

YellowMint Technology provides the following SaaS solutions:

  • Web Hosting Services: Cloud-based hosting solutions for websites and web applications
  • HRMS Platform: Human resource management software for employee data management, payroll, attendance tracking, and HR operations
  • Web Analytics: Data analytics and reporting tools for website performance monitoring and user behavior analysis

3. User Accounts and Registration

To access our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

4.3 Content Standards

For HRMS and analytics data, you are responsible for ensuring all uploaded content complies with applicable privacy laws and regulations, including GDPR, CCPA, and local data protection requirements.

5. Data and Privacy

5.1 Data Ownership

You retain ownership of all data you upload to our Services. We do not claim ownership rights to your content or data.

5.2 Data Processing

By using our Services, you grant us permission to process your data solely for the purpose of providing the Services. Our data processing practices are governed by our Privacy Policy.

5.3 Data Security

We implement industry-standard security measures to protect your data. However, no system is 100% secure, and we cannot guarantee absolute security of your information.

We strive to maintain 99.9% uptime for our Services, excluding scheduled maintenance periods.

7. Payment Terms

10. Limitation of Liability

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YELLOWMINT TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless YellowMint Technology and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or transmit through the Services

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting our customer support or through your account settings.

12.2 Termination by Us

We may terminate or suspend your access to the Services immediately, without notice, for any reason, including if we believe you have violated these Terms.

12.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. We will provide you with a reasonable opportunity to export your data for a period of 30 days after termination.
